What is a Legal Separation?

Are you considering ending your marriage? In California, you can legally end a marriage by filing for a divorce or by requesting an annulment. A legal separation is different because the marriage is not actually dissolved, but the steps are taken to allow the couple to live apart. Whether you are in a marriage or a domestic partnership, a legal separation allows the couple to make decisions regarding who gets what and where the children should live.

There are many different reasons why a couple may choose a legal separation over a divorce. They may not choose this option because of their religion or because there are insurance or tax ramifications. In order to receive a legal separation, you will have to go through the court. The family court will oversee issues like property division, child custody, child support, and more. As to time and cost, a legal separation usually ends up costing the same as a divorce and can take up to 10 months to finalize (also comparable to a divorce).

Legal separation is not to be confused with separation. Separation simply means that a couple is living apart. If this is the case, the court does not need to be notified and no legal action will need to be taken. If you are considering ending your marriage or separating from your spouse, it is highly recommended that you contact a legal representative so that they can go over your options with you. They could help you understand the ramifications of each decision as well as ensure that your rights and best interests are protected every step of the way.
